Vernell Laurthel Hayes, 45, faces two counts of felony DUI resulting in death after a motorcycle crash on S.C. 160 killed two people early Saturday, Oct. 17, Tega Cay police said.

Hayes was driving a car that struck a motorcycle at the intersection of Highway 160 and Tillberg Way, first reported by the Rock Hill Herald. Arrest warrants state Hayes failed to yield the right of way while turning.

Gabriel Williams, 26, of Fort Mill was driving the motorcycle. He died at the scene. Aeryn Sutherland, 31, of Charlotte was a passenger on the motorcycle and died after being taken to Piedmont Medical Center in Rock Hill, according to York County Coroner Sabrina Gast and a Tega Cay police statement.

Williams was traveling northbound on Highway 160 when the car, heading in the opposite direction, attempted a left turn onto Tillberg Way and collided with the motorcycle, according to WBTV.

Hayes "admitted to consuming alcohol prior to the collision," according to the arrest warrants obtained by The Herald. Testing showed his blood alcohol concentration was .13. South Carolina's legal limit is .08.

Tega Cay Police Chief Joey Crosby confirmed the charges. Hayes remains in the York County jail without bail, according to sheriff's office records.

Officers were dispatched to the intersection shortly after midnight Oct. 17 following emergency calls reporting the crash, according to the Tega Cay Sun. Hayes was taken into custody at the scene and transported to the Moss Justice Center in York County.

The Tega Cay Police Department said the investigation is ongoing in coordination with the South Carolina Highway Patrol. No additional details about the mechanics of the collision have been released.

Under South Carolina law, a conviction for felony DUI resulting in death carries a mandatory fine between $10,100 and $25,100 and a prison sentence between one and 25 years, according to the S.C. Department of Public Safety. With assessments and surcharges, the total fine can reach $52,244.50.

The intersection sits south of the North Carolina state line and west of Interstate 77.
